DMCA Policy

Air Fryer Broccoli ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Air Fryer Broccoli service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

This page describes the information that should be present in a DMCA notice, as well as information required for a valid counter-notification.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a written notice ("DMCA Notice") containing substantially the following information to our Copyright Agent:

  1. Identification of the copyrighted work claimed to have been infringed: Provide a description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material claimed to be infringing: Provide a description of the material that you claim is infringing and sufficient information to permit us to locate the material on the Site (e.g., URL(s) where the material can be found).
  3. Your contact information: Provide your name, address, telephone number, and email address.
  4. A statement of good faith belief: Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy and perjury: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature: Provide your physical or electronic signature.

Upon receipt of a valid DMCA Notice, we will act expeditiously to remove or disable access to the infringing material and notify the user who posted the material.

Filing a DMCA Counter-Notification

If you believe that the material you posted on our Site was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification ("Counter-Notice") containing substantially the following information to our Copyright Agent:

  • Identification of the removed material: Identify the material that has been removed or to which access has been disabled and the location (e.g., URL(s)) at which the material appeared before it was removed or disabled.
  • A statement of good faith belief: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Provide your name, address, telephone number, and email address.
  • A statement of consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Air Fryer Broccoli may be found, and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
  • Your physical or electronic signature: Provide your physical or electronic signature.

Upon receipt of a valid Counter-Notice, we will provide the complaining party with a copy of the Counter-Notice and inform them that we will replace the removed material or cease disabling access to it within 10 business days, unless we receive notice from the complaining party that they have filed an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our Site.
